High Court adjourns case against senior pontiff

BANGALORE: The Karnataka High Court has directed
the senior pontiff of Srimadvyasaraja Mutt (Kundapur
Vyasaraja Mutt) not to send the junior seer from the
mutt premises in Bangalore except for religious
purposes.

A Division Bench comprising Justice A.M. Farooq and
Justice Ashok Hinchegeri passed the order on a habeas
corpus petition by a resident of Srinagar here seeking
a direction to the Bangalore police to produce her
minor son (junior seer) who, she claimed, had been
forcibly taken away by the senior pontiff of the
Kundapura Vyasaraja Mutt.

The Bench had earlier restrained Lakshmeendra Tirtha
Sreepadangalu, the senior pontiff, from leaving
Bangalore city until further orders.

In her petition, A.S. Sridevi, said her 12-year-old son,
Srihari, had been forcibly initiated into "sanyas" by the
senior pontiff. The woman said she and her husband,
A.M. Sridharamurthy, along with their two children —
a boy and a girl — were staying in the quarters of the
mutt in Hanumanthnagar.

She said the senior pontiff had several times in the
past expressed his desire to initiate Srihari into
"sanyas" and they had resisted the idea. On June 21,
2004, when Ms. Sridevi and her husband were asleep
in the mutt quarters, the senior pontiff took Srihari to
Kantavare in Udupi district.

The senior pontiff later claimed that on June 22 he had
initiated Srihari into "sanyas." On June 26, when Ms.
Sridevi and her husband approached the senior pontiff
and requested him to hand over their son, she
claimed, he threatened them and asked them to sign
some papers.

The Hanumanthnagar police did not register a
complaint when they sought to file one against the
senior pontiff. He, however, filed a suit in the Sessions
Court of Bangalore praying for a permanent decree and
a perpetual injunction against Ms. Sridevi, her
husband and others from interfering in the "dharmic"
affairs of the mutt and restraining them from taking
back the boy.

The petitioner said her child was innocent and he was
forcibly initiated into "sanyas." She said this was illegal
and arbitrary.The court also directed the senior seer
to allow the parents of the junior seer to visit him.
It adjourned further hearing of the matter.
